Terms of Service.

Welcome to FamilyMake™. These Terms of Service ("Terms") govern your use of our 3D printing services, website, and related platforms. By uploading a file or placing an order, you agree to be bound by these Terms. All services are facilitated by FamilyMake LTD.

1. Manufacturing Services

FamilyMake LTD provides custom additive manufacturing (3D printing) services based on digital models provided by the user.

  • Custom Nature: All products are "made-to-order." Minor variations in color, surface texture, and dimensional accuracy (typically within ±0.5mm) are inherent to 3D printing and do not constitute defects.
  • Technical Feasibility: We reserve the right to decline any order that we deem technically unprintable or likely to fail during the manufacturing process.

2. Intellectual Property & User Warranties

Crucial Ownership Clause

By uploading any digital model to our platform, you warrant and represent that:

  1. You are the sole owner of the IP rights to the model, OR have explicit written permission from the rightful owner to reproduce it.
  2. The production and possession of the physical object do not infringe upon any third-party patents, copyrights, trademarks, or trade secrets.
  3. The model does not violate any local, national, or international laws or regulations.

License Grant: You grant FamilyMake LTD a non-exclusive, royalty-free, limited license to use, copy, and process your models solely for the purpose of fulfilling your order.

3. Prohibited Content Policy

FamilyMake LTD strictly prohibits the printing of:

  • Firearms, functional weapon components, or ammunition ("3D Printed Guns").
  • Illegal contraband or items used for the consumption of illegal substances.
  • Content that promotes hate speech, violence, or discrimination.
  • Models that infringe on existing commercial trademarks (e.g., unlicensed movie characters or brand logos).

4. Limitation of Liability

ALL PRODUCTS ARE PROVIDED "AS-IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. FamilyMake LTD is not liable for any injury, property damage, or mechanical failure resulting from the use of 3D-printed parts in functional or high-stress applications.

In no event shall FamilyMake LTD's total liability exceed the actual amount paid by you for the specific order giving rise to the claim.

5. Indemnification

You agree to defend, indemnify, and hold harmless FamilyMake LTD and its officers, employees, and agents from any claims, damages, costs, and expenses arising from: (i) your breach of these Terms; (ii) your violation of any third-party IP rights; or (iii) your use of the products manufactured by us.

6. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

7. Secure Payments & Settlement Facilitation

To ensure buyer protection and secure transactions across our marketplace, all platform transactions are structured as follows:

  • Conditional Settlement (Advance Payment): When a buyer pays for an order, the entire amount is securely held by our licensed payment processor as an advance payment on a custom manufacturing contract.
  • Vendor Payout Release: Payouts to the vendor's settlement bank account are only triggered once the order status is marked as "Completed." This occurs when: (a) the buyer confirms successful receipt of the items, or (b) a 7-day post-delivery inspection window expires without a dispute being logged.
  • Dispute Protection: If the buyer logs a valid delivery dispute within the 7-day verification window, the settlement remains frozen in our gateway until the dispute is resolved.
