Terms of Service

Welcome to FamilyMake™. These Terms of Service ("Terms") govern your use of our 3D printing services, website, and related platforms. By uploading a file or placing an order, you agree to be bound by these Terms.

1. Manufacturing Services

FamilyMake LLC provides custom additive manufacturing (3D printing) services based on digital models provided by the user.

  • Custom Nature: All products are "made-to-order." Minor variations in color, surface texture, and dimensional accuracy (typically within industrial tolerances of +/- 0.5mm) are inherent to 3D printing and do not constitute defects.
  • Technical Feasibility: We reserve the right to decline any order that we deem technically unprintable or likely to fail during the manufacturing process.

2. Intellectual Property & User Warranties

Crucial Ownership Clause:

By uploading any digital model (STL or other formats) to our platform, you warrant and represent that:

  1. You are the sole owner of the intellectual property (IP) rights to the model, OR you have obtained explicit written permission/license from the rightful owner to reproduce the model for commercial or personal use.
  2. The production and possession of the physical object do not infringe upon any third-party patents, copyrights, trademarks, or trade secrets.
  3. The model does not violate any local, national, or international laws or regulations.

License Grant: You grant FamilyMake LLC a non-exclusive, royalty-free, limited license to use, copy, and process your models solely for the purpose of fulfilling your order, including slicing, print preparation, and physical manufacturing.

3. Prohibited Content Policy

FamilyMake LLC strictly prohibits the printing of:

  • Firearms, functional weapon components, or ammunition ("3D Printed Guns").
  • Illegal contraband or items used for the consumption of illegal substances.
  • Content that promotes hate speech, violence, or discrimination.
  • Models that infringe on existing commercial trademarks (e.g., unlicensed movie characters or brand logos).

4. Limitation of Liability

"AS-IS" WARRANTY:ALL PRODUCTS ARE PROVIDED "AS-IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

FamilyMake LLC is not liable for any injury, property damage, or mechanical failure resulting from the use of 3D-printed parts in functional, structural, or high-stress applications. Printed parts are intended for prototype and decorative use only.

In no event shall FamilyMake LLC's total liability exceed the actual amount paid by you for the specific order giving rise to the claim.

5. Indemnification

You agree to defend, indemnify, and hold harmless FamilyMake LLC and its officers, employees, and agents from any and all claims, damages, costs, and expenses (including attorney's fees) arising from: (i) your breach of these Terms; (ii) your violation of any third-party IP rights; or (iii) your use of the products manufactured by us.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the **State of Delaware, US**, without regard to its conflict of law principles. Any legal action shall be brought exclusively in the courts located in Delaware.
